Introduction

1. The Hamdan bin Mohammed Heritage Centre is fully accredited to preserve national heritage and a platform to organise a number of championships and initiatives driven by His Highness, Sheikh Hamadan Bin Mohammed Bin Rashid Bin Saeed Al Maktoum the Crown Prince of Dubai. The Centre is referred to throughout as ‘we’, ‘us’ or ‘our’. References to ‘you’, ‘your’ and ‘yours’ indicate you, the person(s) accessing our websites (singularly ‘Site’ and collectively the ‘Sites’).

2. The contents of this privacy policy (‘Privacy Policy’) apply to all of our Sites including their contents, and to any correspondence by e-mail between you and us sent through any of our Sites.

Collection

1. We may gather two types of information about you from a Site:
   • Personal Information, provided by you at the time of voluntary registration for the services offered by us such as (but not limited to) your name, email address, mailing address, telephone number, date of birth, gender and nationality (‘Personal Information’); and
   • Aggregated information generated by our systems, which track traffic to our Sites but not Personal Information.
2. Failing to provide necessary personal information when requested may result in certain services not being available to you.
3. By providing this Personal Information to us you acknowledge and agree that the information you provide to us is not confidential.

Disclosure of Information

1. We may disclose:
   • Any information that we gather about you to third parties for the purposes of providing you with additional services;
   • Aggregated tracking information and other information that does not personally identify you to third parties;
   • Your personal information to third parties, when we believe in good faith that we are required to do so by law; and
   • Your personal information to third parties, provided we have your prior consent, which may be obtained at the time of collecting the information from you.
2. We will not share your Personal Information with any third party unless you have provided your express consent. We maintain strict security standards and procedures with a view to preventing unauthorised access to your data by anyone, including our own staff.
3. We will not transfer your Personal Information outside of the United Arab Emirates without receiving your express consent.

Use

1. We may use your Personal Information:
   • To verify your identity and assist you if you forget your password or login details for any of our Sites;
   • To assist in providing services requested by you;
   • To provide further information to you about other sites and services which we consider may be of interest to you;
   • For future marketing, promotional and publicity purposes, including to carry out direct marketing, market research and surveys;
   • For ensuring that you are shown the information that is most relevant to you and your interests; and

  Cookies and Tracking

We use a ‘cookie’ file containing information that can identify details of your IP address; operating system (e.g. Microsoft Windows, Mac O/S, Linux); browser (e.g. Internet Explorer, Safari, Firefox, plus the version of the browser); domain (whether you are accessing the Site from Dubai or elsewhere) and other user information (e.g. your username).
2. We may use the information generated by cookies to:
   • Track traffic patterns to and from a Site;
   • Ensure that any advertising is being shown to the most appropriate person; and
   • Enable you to enter a Site, use certain services and to visit registered user-only areas of a Site.
3. You can choose to refuse cookies by turning them off in your browser and/or deleting them from your hard drive. You do not need to have cookies switched on to use a Site, however you will need them to log on to a Site and to access personalised or secure content on it. Additionally some web pages may not function properly if the cookies are turned off.

Content Providers, Advertisers and Partners

We are not responsible for the data collection practices, the privacy policies or the content of any sites other than our own Sites, including those sites accessible via a link from one of our Sites. Opting in and Opting Out

1. If our intended collection, use or disclosure of your personal information is outside the collection, use or disclosure parameters in this Privacy Policy, we will give you the option to:
   • Opt-out and not receive certain services or participate in certain interactive areas; or
   • Opt-in to agree to be contacted by us in relation to certain matters such as notification of new features to a Site, beta testing or promotional activities.

Holding, Correcting and Updating Information

Amendments

1. We may change this Privacy Policy at any time, without notice. You agree that our Privacy Policy’s current version applies to your use of a Site.

This End User License Agreement ("Agreement") is between you and Elmeydan App and governs use of this app made available through the Apple App Store. By installing the Elmeydan App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the Elmeydan App. In order to ensure Elmeydan App provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content or abusive users. If you see inappropriate content, please report it using the report option or use the "Contact Us" feature found under "Settings". 1. Parties This Agreement is between you and Elmeydan App only, and not Apple, Inc. ("Apple"). Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. Elmeydan App, not Apple, is solely responsible for the Elmeydan App and its content. 2. Privacy Elmeydan App may collect and use information about your usage of the Elmeydan App, including certain types of information from and about your device. Elmeydan App may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Elmeydan App. 3. Limited License Elmeydan App grants you a limited, non-exclusive, non-transferable, revocable license to use the Elmeydan App for your personal, non-commercial purposes. You may only use the Elmeydan App on Apple devices that you own or control and as permitted by the App Store Terms of Service. 4. Age Restrictions By using the Elmeydan App, you represent and warrant that (a) you are 17 years of age or older and you agree to be bound by this Agreement; (b) if you are under 17 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the Elmeydan App does not violate any applicable law or regulation. Your access to the Elmeydan App may be terminated without warning if Elmeydan App believes, in its sole discretion, that you are under the age of 17 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child's use of the Elmeydan App, you agree to be bound by this Agreement in respect to your child's use of the Elmeydan App. 5. Objectionable Content Policy Content may not be submitted to Elmeydan App, who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker. 6. Warranty Elmeydan App disclaims all warranties about the Elmeydan App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Elmeydan App, not Apple, shall be solely responsible for such warranty. 7. Maintenance and Support Elmeydan App does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, Elmeydan App, not Apple, shall be obligated to furnish any such maintenance or support. 8. Product Claims Elmeydan App, not Apple, is responsible for addressing any claims by you relating to the Elmeydan App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Elmeydan App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims. 9. Third Party Intellectual Property Claims Elmeydan App shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the Elmeydan App. To the extent Elmeydan App is required to provide indemnification by applicable law, Elmeydan App, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Elmeydan App or your use of it infringes any third party intellectual property right.

Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Elmeydan - Family Organizer App mobile application (the "Service") operated by Elmeydan. ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Communications

By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness. Elmeydan. has the right but not the obligation to monitor and edit all Content provided by users. In addition, Content found on or through this Service are the property of Elmeydan. or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. Termination

Limitation Of Liability

In no event shall Elmeydan., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Dubai ,UAE, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
